Leaking Roof

I closed escrow on a 6 year old home on Oct. 25 (less than 4 months ago). After the first rain of the season, I noticed a massive water stain on my garage wall. I have a 2 year roof cert and called the roofing contractor. It took them almost 2 weeks to get here to take a look at my roof. After that, it took 3 visits to fix the leak. It appears to be fixed now.

It rained yesterday. Now there is a water stain appearing on the ceiling in the hallway. I called the roofing contractor. He said he would get someone here as soon as possible, but that he is short-handed. It's supposed to start raining again in a couple of weeks.

I am very upset about this as I just bought this home less than 4 months ago and the roof leaks!

What are my legal rights here? I feel like I've been cheated.

What did the inspection report show?

Had it leaked before you bought it?

Did the contractor give you a warranty?

This is not legal advice, but in general, the only way to fix a leaking roof is to take the old one off and put a new one on. Leaks may be coming in from a tiny hole at one end of the house and dribbling down to the other end. These kinds of leaks are nearly impossible to find, much less fix.

Answer to Questions

The Inspection Report shows: "Roof Certification- The roof at the above address has been inspected by a Licensed California Roofing Contractor. Said roof is found to be in satisfactory condition for a two year certification. This certification guarantees roof leak repairs only. Metal and fiberglass patio covers not included in this certification".

To my knowledge, the roof did not leak before I bought it. The disclosure statement from the seller had no indication that there was a leakage problem.

Regarding Contractor giving a warranty, I believe that falls within the Roof Certification?

ok, I have moved my original post/thread to this one...I have no other threads going here and so have no original thread to move it to.... did not want to hijack this one which is why I started a different thread the first time...but, at your request, here it is again.....thanks :D

similar situation as above (sorry, didnt know if I should start a new thread or add on ) except I am the seller.....roof is 1.5 yrs old, I had it put on and did it as owner/builder...the buyers are telling me the flashing was done incorrectly and therefore leaked, they had it fixed by a roofer...roof was inspected (no warranties given) ground only and noted that buyer should hire a licensed roofer to do a further examination (they did not opt to do that), no roof coverage was added (or asked for) on the home warranty plan I purchased for them, I had no leaks/damage in the 1.5 yrs I had the roof...so they are asking me to pay half (1750.00) to help compensate them...I have been literally badgered on this since january...can I tell them to leave me alone? or am I somehow responsible....I disclosed everything I knew at the time of the sale (the agent said I disclosed way more than most of his clients do)how can I disclose leaks or incorrect flashing if I dont know about them...if I dont remember the guy that did the roof, can they make me pay?? I mean, do I have to be responsible for my home AND my old one??? when does it end.....
