leaking roof

What is the name of your state (only U.S. law)?nj

The roof of my detached garage roof has been leaking for over two years. The condo board promised to replace the roof several times, but made excuses and used band-aid approaches. Now, after 23 years as a common element, the board says I own the roof and a special assessment will be made for the repairs. The master deed clearly calls it a common element, but it also says the findings of the board are binding on all unit owners. What can I do other than pay?

file a small claims action to force the board to fix the roof. it really depends on the wording of the deed, etc.

**A: hire an attorney and go after the Board.
