I am filling out a fee arbitration against my ex attorney and have a couple of questions.
Part of the fees charged were due to phone converstions (to/from real estate agent/my attorney/my attorney brother-n-law) reviewing changed contracts when selling my home. The attorney deserves to be paid. However, the calls and changed contracts were made and changed by my brother-n-law (a real estate attorney in another state). I have Emails from him 2 years ago (when my very bitter divorce begain) stating he wants no further communication with me and not to contact him. I have my Emails to him stating he stay out of my financial business and any financial business that concerns my husband and me. That I do not want his advice, do not trust him, and stay out of my life.
He contacted my real estate agent directly and began changing contracts. He also talked many times to my attorney without my knowledge about the sale of the house, who then started calling the real estate agent concerning the changes. I did not know until till I got the bills. I got charged for all these calls and Emails, over $2000 worth. I believe he crossed the line of just giving 'brotherly' advice when he started giving his professional legal advice to my agent and talking to my attorney, especially without my permission. I believe he should pay the attorney fees I am being charged. He had no right to interfere in my business and certainly had no right to contact my attorney and discuss the sale of the house and contract with him. Should I send him the bill itemizing the cost of his calls of reviewing his changed contracts? Should I contact my ex attorney and have them send my n-law a bill? Or should I put it before the arbitration board?
