Legal name of minor child

What is the name of your state? Colorado
My daughter was given my last name at birth, due to her father wasn't around in the picture until she was 9 months old. I just recently found out that he and his wife, and their kids have been telling our daughter that her last name is his last name. That is not how it is legally, and he has wanted to change her last name to just his for some time now... when i politely try and tell our daughter what her last name is (mine), she gets confused and says that daddy said that it was her name with his last name. I have asked him to stop this immedietly, and have had no luck with his cooperation. Do i have any legal recourse? My feeling is that he is trying to do this, to make it easier to change our daughter's last name to his, to make it easier to change the custody etc. Or am i being unreasonable?

This is a non-issue.

What the child is called has absolutely no bearing on custody matters. If he won't stop then you have three choices:

1. Louisville slugger;

2. Ignore him;

3. Petition the court to amend the visitation agreement to include that no one is to mention names or the changing thereof (IF you can get a judge to listen to this crap).

Its not fair that he is confusing the child like that. At a minimum its poor parenting.

Make a photocopy of her birth certificate and SS card and any other ID you have showing her legal last name.

Send him a certified letter with all of the photocopies and request that he cease telling the child lies regarding her last name.....that he is seriously confusing the child.

It may not help, but at least you will have documentation that you tried to get him to stop confusing her.
