Non income Invetsment protfolio was split after divorce. Husband continued to hold it, wife sold it and earns substantial interest income.

A Judge inputed me with the income from non income producing investment portfolio. Based on 5% interest earned from the value of my retirement portfolio.

Under what circumstances it is legal to impute investment income that is not earned in California ?
