i am a single mother. when my son was born the name of his paternal father was withheld from the birth certificate. he is an absent parent. soon i will be getting married and my fiancee wants to legally become the father of my son. how do we go about doing that and how do we have my sons last name change from my maiden name to my fiances? please help.

Why don't you try to establish paternity? Why haven't you done that?How old is your son?
In order to change your son's name you would have to file in probate court for a name change.
Does your son know who his father is? Or does he believe your boyfriend is his father?

As a very general rule, you're looking at an adoption - which is not a do-it-yourself project. You'll need an attorney.

The father will probably need to be notified and will have the chance to object. If he doesn't object, it won't be too difficult (but you'll still want an attorney). If he DOES object, you are unlikely to get what you want.

After you've been married for 2 or 3 years, then hire an attorney to handle your stepparent adoption - if you are all still in favor of it by then.

And make sure that your fiancé realizes that if you and he get divorced, he could be on the hook for many years of child support.

OR, your fiancé could get custody and you could end up being the non-custodial parent and paying child support.

Never go into an adoption without both parties realizing the full consequences.

Oh, and btw, what did you do to encourage Dad's relationship with the child? If you ran to another state without leaving any way for Dad to contact you, his lack of contact is a little easier to understand.

and no you cant have your bf sign the bc. you both know hes not the dad and you can find yourself in legal hot water. putting false info on the bc( which is an officail document) is fraud). nor does changing your sons name to your bf make him the dad or give him rights. untill he adopts he is a legal stranger with no rights.
