What is the name of your state? Nevada.

Your site states:

IS THERE A LEMON LAW FOR USED CARS?
Yes - if you receive an express written warranty with the vehicle. An express written warranty can be either a) the balance of a manufacturer’s warranty, b) a separate limited warranty given by the dealer, or c) an extended warranty or service contract you purchase from the dealer at the time you purchase the vehicle. If you have such a warranty, the substance of the new car lemon laws apply.

I purchased a used Auto from a dealer and they sold me an extended or after market warranty. This warranty is not from the dealer itself but from another company. However the dealer acted as the agent and sold it to me in my sales contract.

Does this warranty, sold by the dealer, apply for the lemon laws in my State?

Nope, and for several reasons (and not that "lemon laws only apply to cars, not warranties.)!!

The main problem being that though Nevada Revised Statutes do make mention of the law applying if a vehicle does not conform to the 'manufacturer's applicable express warranties', it does not apply to USED vehicles.

The second problem is that your '3rd party warranty' is not a 'manufacturers express warranty'.

"NRS 597.610 Report of defect in motor vehicle; duty of manufacturer.
If a new motor vehicle does not conform to all of the manufacturer's applicable express warranties and the buyer reports the nonconformity in writing to the manufacturer:
1. Before the expiration of the manufacturer's express warranties; or
2. No later than 1 year after the date the motor vehicle is delivered to the original buyer, whichever occurs earlier, the manufacturer, its agent or its authorized dealer shall make such repairs as are necessary to conform the vehicle to the express warranties without regard to whether the repairs will be made after the expiration of the express warranty or the time described in subsection 2."

Bah. There's no way you were able to decipher the true question this guy had from that first post. :D Heck, I suspect the OP doesn't even know what he's asking.

I disagree.... and though he was confused about his warranty, believe that my assumptions as to his questions are accurate.
Simply, the writer purchased a used car and the dealer sold him a 3rd party warranty. He was asking whether this warranty gave him any 'lemon law' rights. Your post was INCORRECT in that you assumed he was asking about the warranty, when that clealry was NOT what he was asking about.

No kidding, however, that is what he wrote, which is where my sarcasm sprung from. Your post was incorrect in that you assumed I was giving a serious answer :p

Thanks JETX you got it right. Thanks also to You Are Guilty for pointing out my grammatical error. However, I might add, You Are Guilty is evidently a believer in the adage "If you can't dazzle them with brilliance then baffle them with BS."

Have not talked to Carl, I will make a briefcase of one this week. The latest briefcase was all vacation pics of "Geography". I'll send one out as soon as I make a new briefcase, but not this weekend as we will be gone.
