Licence suspension for non payment of CS

What is the name of your state (only U.S. law)? NY

A few years ago my ex had not been paying child support so the court took his licence.... He asked me to file for it to be returned to him... I don't remember this happening... I looked through the CO's and it was not in there.... He said I was not in court for it, I'm very confused at this point... I'd file for him to have the restriction removed if I could but I am not sure how to or even if I can... he had been paying support but is unemployed again.... we go back to court on June 8th.

Its really not up to you. The only way that you could do anything that would get his license back to him is if you asked the court to cancel his arrearages....and....if you have had any kind of state assistance at all, you cannot even do that.

I'm not on any state assistance....


I feel bad that he does not have his licence however he owes 10k in arrears and I'm not that nice, don't know many people that are.

he has to file. not you. if he wants his license back, he needs to get off his butt and get it done. you are not his attorney, you cannot file on his behalf.

If you're not that nice to forgive the arrears ,and the State is not / hasn't been involved in giving you public assistances , then he has to bring his arrears current to be able to have the suspension lifted , would have to if you did receive assistances too.

If he's recently unemployed through no fault of his own , he needs to file a downward modification of his obligations .This won't effect the arrears he now owes though , just the current monthly obligations .

According to him he quit...... It's nothing new he had just been making sure he had a job before quiting. The judge has warned him about it before.

LOL are you married/divorced from MY x husband?? :D He quits jobs frequently, always without having another job waiting!! He has been found in contempt of court for failure to pay child support in a timely manner 3 times now, and he too has been warned about quitting employment. Here I thought this guy was unique! :rolleyes:
