This weekend i was charged with a DUI in New York City. I am a resident of Massachusetts. My lisence is suspended in NY but is it in MA?? The lawyer did not know.
 


The state that your license would be suspended in would be the issuing state. Unless Mass and NY DMV computers are linked, your license, if issued from Mass would be suspended in Mass. Since it is suspended, you are not a licensed driver until you get it re-instated.

my lisence is issued in MA, the incident happened in NY. Also, i was not read my miranda rights (i believe that is what they are called) but i was read my rights to take a breathalizer. Also, how long will it be suspended for, 1 year? I am only 19 years old to, does that change anything. Lastly, i talked to a lawer and he said that there is a possibility that i could get it down to a traffic infraction, i am in a good school and have a good job. Will that effect a suspention at all?

Getting a DUI down to a trafic infraction. That's a good trick. Did your lawyer give you any odds on that happening 1:100, 1:1000?

But seriously, being 19, you are more likely to get in trouble because you have no right to be even at 0.01 BAC since you are underage. And miranda rights only apply to questioning of people who have been taken into custody.

Taking a breathalyzer or being told your breathalyzer rights does not constitute illegal questioning absent miranda.
