My wife wants to begin divorce procedures and she was told that in California the process can not even begin until one of us has moved out of the house. Is it true that we can not live under the same roof and begin the divorce?

Unless there's some new case law on the subject that I'm not familiar with (which is highly doubtful), then I'd tell her not to hire that attorney. So, no, it's not true.

Maybe she lied and thinks (true or not I don't know) that if he moves and she stays in the house that she'll get it in the divorce. Remember the movie "War of the Roses"? (woof)

Thank you for your input, hakwaitress, but I was looking for the opinion of an actual attorney, not to discuss the last movie you saw.
