LL refuses to acknowledge security deposit

I moved in to Warwick Station Apartments (managed by Equity Resedential) in October 2002. They required my security deposit, credit report fee, application/office filing fee to be on one money order and the first month's rent to be on another money order. They did not give me receipts.

I moved out is October 2004 and was told by the office that I would be notified through the mail about any refund or money owed. I received a bill for $268, and noticed that it did not include my security deposit. I called to complain and they said they showed no record of any security deposit being paid.

I do have proof in the form of a HUD form since I was on housing assistance at the time. I mailed a copy of this proof to their office, but they say it doesn't serve as proof. The thing is, their representative filled out the HUD form and sent it to housing, so either they lied to HUD then, or they are lieing to me now.

What should I do? I know I paid the security deposit, and the HUD form is the oly proof I have, but they refuse to acknowledge it. The deposit was for $150, which is less than the amount due, but I am willing to pay the difference. I just will not pay that $150 twice.

The original lease acknowledged the security deposit. However, my copy of it is in the files of a man whom I now have a restraining order against and who lives in Oregon. The office will not allow me to look at the lease they have in person, nor will they send me a copy.

Up sh## creek with out a paddle.

Your only hope is if you were to sue the landlord turns up with a lease but it will probably stay in his pocket as it is your job to prove why you are owed.
