I live in Georgia. In 8-02, I moved into an apartment, the first I had ever lived in, as I had always lived in houses. The landlord told me she was going to repair various items in need of repair, which I, being ignorant to all this stuff, did not get a written walk thru statement for either of us. Since then, my apartment has flooded several times, and she admitted it had flooded prior with the other tenent; the kitchen had a leak which after months of 'swimming thru the kitchen' and taking my life in my own hands with the washer and dryer and stove and all electrical appliaces and water coming up thru the tiles, puddling and all that mess, discovered it was the hotwater heater. Now with water everywhere, and my reporting the problem very promptly as I should have, in which she did nothing until months later I finally figured it had to be the hotwater heater. She then yells at me " I CAN'T BELIEVE IT TOOK YOU THAT LONG TO FIND OUT WHERE IT WAS COMING FROM'. WITH WATER EVERWHERE, HOW COULD I AND WHY DIDNT SHE, AS THE OWNER, SEND SOMEONE TO FIND THIS?
There is mold behind my washer and dryer, and when Imoved in there was a portion of the baseboard that was black and slick with mold and the sheetrock was wet, for about almost 2 yrs. After water heater was replaced, in several months, the black, slick, greenish mold began to dry but you can see the mold problem. I looked up mold on the internet and i am in trouble. There is also mold that came thru the 1/2 bath on the lower level, next to the washer and dryer in the kitchen, on the walls and baseboards, I called her and after several months she finally acqknowledged it and came over, said or did nothing. There is mold on the wall behind my washer and dryer, and in the little storage room, all I have out there is ruined and rusted with mold all over the wall and the concrete floor black due to the water damage. I don't think any of my possessions are salvagable. Next, I was sitting on my sofa, in front of a double window, and have a large rug there that goes out and under the coffee table and love seat...I noticed while barefooted, it all was soaking wet as it had been raining for a while.....i pulled the sofa out..stepped into the carpet back there and water came up nearly to my ankles. The house at the foundation is rotted and it would pour water and I would have to swim here when it rained. I know the carpet is covered with mold underneath as well as the padding, all the way out to where the water finally stopped..it kept growing. She returned no calls, did nothing. then the window, at the top of the frame began pouring water and soaking my sofa,(after my loveseat, sofa and furniture already smell like mold, mildew and is ruined, along with all my possessions, as well as clothes. I cannot even get clothes out of my upstairs or downstairs closet to wear unless i have to wash them first to TRY and get the moldy, mildewy, stinking scent out.) When you walk into my apartment, this scent is all you smell. I have mentioned it to her several times, and the repair, and she tells me 'if I don't like it can move.
the the leak began over 2 yrs ago on my living room ceiling. Mind you I have a bedroom upstairs...she refused to send anyone or do anything and it is almost 3X3 by now, water dripping, the texturizing long has fallen off, and as we all know the water causes harmeful to health and everything mold. It was only 3 weeks ago she finally sent this man who cut a whole in the ceiling and saw all the mold and rot, which has rotted the floor in my bedroom upstairs. You can step on it and it caves. I have put in many calls to her, and when she finally called, denied getting them ones I left on her machine. this was tonight.
I have always paid my rent on time, she has talked tome like i was a dog, and the woman 2 apts. down feeds stray cats, which the animal control tells her 'they are now her cats as she feeds and waters them to keep them and accepts all responsibility for them. They have scratched the paint on my car down to the metal. They are deystroying it. I notified the landlord several months ago and she says 'those are strays and it does not matter what the animal control says'. I am and have been waiting on my didability since 12-02, and have been waiting since 12/03 for a hearing. The landlord and myself came to an agreement that my rent would be dropped to $500.00 due to the water damage, and then it was going to be dropped to $400 per month UNTIL my disability came thru, and that I would repay her the back rent of $100 per month when it did. No specifications were made as to how I was to pay her, but I planned to pay her monthly, as my rental break was monthly and there would be no way I could pay her all at once as if and when I got back SSD pay, I had to pay persons helping me pay rent here , plus my plans to pay her montly until I was paid in full with her. As we were at my home, I typed out this agreement I signed it and I mailed it to her. She accepted it, though she didnt say anything or sign it as there was no place for her to do so. She was very happy that I did that, agreeing to pay her all that I would owe when I get my disability.
When she finally called me tonight, stating that the only got one message out of the 3-4 I left concerning the property here (go figure--same machine...1ast message told me she was talking on her phone) She demanded that I pay her all the back pay at once...which she renigged on the agreement last month to drop my rent to $400 until I got my disability, I had to pay her the $500, even tho our agreed upon written agreement says otherwise, I paid her to keep down trouble, for I have no where to go. She told me that since I was not going to be able to pay her it all at one time, which I never agreed to, that she was going to get a dispossery against me, even tho I have not broken any lease, paid my rent on time, kept my mouth shut about all of the failure to repair and the mold in here. She tried to state I said I would not pay her..I was smart, I turned on the phone recorder and got that part, and about the agreement and all that. My breathing started getting bad and then worse due to living here in the mold. It is terrible, and I have no where to go so I hushed, yet I did my research on mold caused by water damage in a home, and the health problems it causes.
My lease states that it is a 1 year lease that automatically renews UNLESS it is put in writing by either the lessor or lesee at the end of the lease, that it would go to a month to month tennancy. That has not been done, and according to her lease, I am still a leased tenant, not a month by month because I was never notified. Am i right? With all the misspelled words in her lease, I am wondering to it's legality or its onesidedness. It also states that irregardless if myself or someone is injured here, EVEN Tho is it due to HER neglegence, he is held not resonsible. Is this a legal thing to put in a lease when injury can be caused by her failure to repair premises to habitable, and non injurus, after she has been given ample written and verbal request?
This is a mess, and looks like even tho I have paid my rent, done all I am supposed to do she is going to evict me because I told her whenever I got my disability payment, i was not going to pay her in one lump sum, as I had told her before, but make monthy payments to her until it was paid in full. what about her renigging on the written agreement between us? What can I do. I am between a rock and a hard place. My belongings are ruined, I have no home owners insurance, and I cannot find the web page stating the if the damage was caused by her pure neglegance, she would have to pay for my losses.
can she evict me? Is she responsibile for her pure lack of neglegence and uncaring to repair the apartment, for the damages to my belongings?

there is more to this and this is long and I pray to God someone will help me. Ever since the city forced her to retire, she thinks she can talk and treat human beings who are trying to do as the law says, and be nice, like they are dirt under her feet. Like filth. I have no family ... no where. I really want to tell someone who can help me the real entire story, but this is just the high spots. SOMEONE HELP ME FAST!!.
