Louisiana Medicaid

My father has Alzheimer's and is in a nursing home. My sister has his power of attorney. He had a checking accounts and CD's that amounted to about $29,000.00. He receives $2100 a month from a retirement check and social security. The remainder of the nursing home bill ($700) my sister has been paying from his money. He has been in the nursing home for almost 2 years. My sister took his money from the checking accounts and cashed the CD's. She (and her husband, a doctor) are now telling us that he only had $15,000 in checking and CD's and they are about to run out of money. They want us to sell his land that was to be split 5 ways when he dies (about 36 acres), and use the money for his nursing home bill. They then want to turn it over to Medicaid to pay the rest when that money runs out.

My question is, will Medicaid check into the money he had first or will they just take the land and sell it, if we hold on to it? Or can my sister, having power of attorney, sell it without our approval? Myself and my other sister do not think it is right that they are trying to keep his money and make us give up the little bit of land we would get. I have not confronted them because I don't want to cause a fight if I can help it. But, I do have bank statements that they are not aware of, that prove what I am saying.

If she has POA -- a full not a limited POA -- your sister can do anything that your father would have done. As for ".. they are trying to keep his money and make us give up the little bit of land we would get..." YOU ARE NOT ENTITLED TO ANYTHING! That land is your father's. If it needs sold to take care of him, then it needs sold. How do you knwo that your sister didn't spend the money on his care or upkeep of the house? You MAY -- not definitely will but may -- be able to push the issue in court to get an accounting to make sure your sister isn't just spending money on new clothes or what not but that will cost money. But you are not giving up anything. The land belongs to your father. If you want it and it needs sold, then buy it. But the first priority is making sure your father is taken care of.

Yes, I realize it is for his care and that is what I care about. (believe it or not) I guess you did not read the part where I said my sister told me that she only got $15,000 and THAT IS WHAT HAS BEEN SPENT. I know for a FACT she got double that. I really don't care about the land and had already told her she could use my part. I just don't think it is right for them to use the money for their own personal things and not for my Dad's care and sell the land before the money he had is gone. And, no, they did not spend it for upkeep on the house. Another sister is taking care of that. But,I guess you are probably right. They can do what they please, since they have POA.

I guess you assume I must be asking only because I am trying to "get my Dad's money or land". The question was about Medicaid. I did not need a lecture on my motives. Thanks for nothing.

And you apparently didn't keep reading what I said about the fact that you MAY be able to get an accounting of where the money went. You are welcome for nothing.

Gee, you caught me! You're right. I'm just a gold digger, out to get my Dad's land! It is only worth $500 an acre and I would get a grand total of $2500. yeah, that's what I'm fighting for! Boy, you're smart. It has nothing to do with the fact that my sister is trying to hide $15,000 from Medicaid and keep the money for herself. I guess it is more important for you guys to try to give me a moral lesson than to give me an answer about MEDICAID FRAUD.
You have instantly decided who is right and who is wrong. I didn't know that I had to justify myself, I thought this was just to answer questions. Sorry. I really did not want to go into all the nuances of what was happening in my family. Sorry I took up you guys time.
