Major ISP Layoff and Sexual Harrasment

Recently I was working for a Major Internet Provider that decided to outsource all of its jobs to the Philippines and India. I was one of the people that was sent to train in the Philippines before the layoff and the building closed.

However, right before I left one of the Project Managers called me into his office and decided to show me his... well you know. Knowing that I was leaving and he felt safe he did it. After that he sent me a message saying " sorry it wasnt hard"

That night I went home feeling like I must be a horrible person to have someone think that they can do this to me, and ashamed.

the next day he sent me a message saying how sorry he was.

However, I had to sign paperwork for this company in order to recieve my severence.My question, do i have any recourse?

Did the paper you signed include waiving all your legal rights to file any claims or suits against the employer and their agents for violations of any employment laws? If it did and you signed it and accepted the severance, then you very likely have no recourse although not having seen the document, no one here can tell you if it was properly constructed. You'll have to show it to an attorney.

By the by, what that manager did was perverted but you don't have much of a claim to bring under any employment laws. (a) You did not report the incident to the employer; (b) you were not physically assaulted; and (c) you did not suffer an "adverse employment action" because of what he did.

You're still free to report the incident to the police as you almost certainly can pursue criminal charges against the guy, even having signed the waiver. I'd guess you're not the first woman he's done this to.

That's what he wants you to think. The truth is, HE is the horrible person for thinking he can do this to ANYONE. YOU are not at fault. YOU did nothing to be ashamed of. YOU are not the horrible person.

Don't take responsibility for what HE did.

The next time something like this happens, just POINT AND LAUGH!

Then march right into the HR department and file a formal complaint.

Men don't like it when you point and laugh. Ask me.....I KNOW!!! :(
