This is quite involved so please forgive the length. My daughter and I have been in the middle of a custody battle for her daughter for nearly two years. The biological fathers parents have consistently harassed and fought us for custody the entire time. I have had custody of my granddaughter since she was 2 days old. My daughter has been with me the entire time. My goal has never been to keep them apart, just protect them. There has been court ordered grandparent visitation for the father's parents. We were informed that on every visitation, the other grandparents take her to the doctor or emergency room in order to try and find something to use against us. Well, they finally succeeded. On their last visitation I informed them that she had had a diaper rash due to the antibiotic Augmentin. She had been prescribed Nystantin Creme for this and that the diaper rash was almost completely gone but to please keep diaper rash ointment on her so that her bottom didn't become raw again. They took her to an ER, without consent from me again, and told the doctor that she had a suspicious diaper rash. The doctor claimed that my 22-month old granddaughter "acted poorly" when she tried to examine her rash. The doctor also said that she did a "vaginal" exam on her and determined that she didn't have a "hymen". She called children services and the police about her belief that my granddaughter had been sexually abused. She advised the non-custodial grandparent's not to let her come home. Within four days, we were back in court. My granddaughter was put in state custody to stay until she saw a specialist in child sexual abuse. The specialist said that she does have a "hymen" and that there were no signs of sexual abuse. I'm sure that anyone who is a parent is probably appalled at the fact that this can happen. Our family has been put through literal hell and are still going through it because of this. My granddaughter was happy and healthy and the center of our universe. Now she is quiet and shy and so unhappy. She has been put through so much and it isn't over yet. Please, can someone tell me if this is malpractice or incompetence or both on the ER doctors part? Once this is straightened out, is there a possibility of a lawsuit? Someone needs to pay for what they have put this sweet child through. Also, did the non-custodial grandparents have the right to seek medical treatment without my consent? Did the hospital have the right to even treat her? Any advice would be greatly appreciated.
