Mandatory exercise in my work place.

Recently, my ESOP (employee owned) Company instituted a mnadatory 5 minutes of stretching exercises before work each morning. It was not part of my job description when I started here 4 years ago and as far as I know that job description has not been changed. My question is simple, can an employer leagally force you to do exercise if you choose no to? Several workers have been given verbal warnings for missing said stretching sessions. I have had back problems in the past and am concerned about this activity, but am more concerned that if I refuse to participate, they can terminate my employment. Any help would be appreciated.

You're undoubtedly haven't exercised in years. Any Chiropractor or Orthopedist will tell you that conservative exercise is good for you - - as well as keeping you well for your employer's sake.

Geez, get up and do the lousy five minutes!

And you would be soooo wrong! I am in fact a 47 year old male that exercises 3 times a week at a gym with a personal trainer (because of my back). I also am a musician and play in a band that performs 2 or 3 times a month. I am very active for your information. It is not the activity that concerns me, it is being told that "I have to" that does. Call it a problem with authority or whatever you like, I just don't like to be forced to do something I feel is a waste of my time while I am work. I did not seek your assinine assumptions. Lucky me, my first post here and you were here to brighten everyone's morning with your wit, sage wisdom, and legal knowledge. How did I get so far in my life without the benefit of having known someone as intellegent and helpful as you obviously are? Your friends must feel so lucky to know someone like you, someone to help them with their everyday little problems. I may be new to this forum, but not to others. I've been flamed by many better than you. I will not engage in a battle of wits with an unarmed man.
If there is any one that can offer any real assitance I thank you in advance and apologize for my sarcastic tirade. I can't stand TROLLS. If you have nothing positive or constructive to offer someone asking for legal help on a legal help forum

Thanks guilty. As I said,(realizing that my initial post made it sound like it was the activity I was opposed to) I do not like to be told I have to do something that's good for me because someone else says it is. I believe that life itself is inherently dangerous and I do not need the government or my employer infringing on what I feel are my personal liberties. I like my job, my company as a whole, I make an extemely good living, and will of course comply with these exercises. This question was only asked for my own information. I thought this forum would be a place to ask it. Thanks again.

jake, to answer your question, yes, your employer can insist you participate in a stretching or exercise program at work. Your employer can require you to do anything as long as it's not illegal or a violation of safety regulations.

The fact that it's not in your job description is irrelevant. A JD is simply an arbitrary list of job duties complied by your employer.

Thanks Beth that was all I wanted to know. I know it may seem stupid (obviously to at least one person that read my post) to some, but in this age of our governement legislating their idea of "safety", this new policy just bugged me. Thanks again.

jake5158, Beth3 is (as always) correct. However, I am with you. This is stupid. I have 25 women working for me. If I tried to institute this policy, I would be a dead man.

:D pretty funny SJ. The women here have actually embraced this new policy and I have heard little if any complaining from them. It has been we men that have are whining the most about it. Thanks again.
