Married 1/2 yr owned home before...help me ? ?

I got married in October. My wife is battling depression and says maybe she doesnt want to be together anymore. This whole situation is very sad for me but financially I have to wonder...

I owned my home for over 10 years before we were married.

What rights does she have to this property ? I hope not 1/2 since I have just barely gotten by purchasing this home and making the payments.

Unless you were dumb enough to put her name on the deed then the answer is ZIP, ZILCH, NADA...yada, yada, yada.

Sounds like you owned the home long before she entered the picture.

Unless after you got married, you added her name on the mortgage, she has no claim to the home.

She can try -- but it's your house - - - a friend of mine went thru similar thing last year......... he tried to get something out of it, but she has purchased the home in just her name so he was up sh-- creek without a paddle.

He walked away with what he had when they entered the marraige - your wife will probably have the same

California is a community property state. She is entitled to 1/2 the marital assets and debts, that means that she may be entitled to some of the equitity from the time of your marriage and you can buy out her interest.

1/2 year marriage...it won't be much.

Lucky you aren't in Alaska as living in the home together would mean it has become a marital asset. Depending on the judge, you may not even have to have lived in the home together.
