Hey all -

Just wanted to let everyone know - I filed for Chapter 7 in March, and I get a letter from an attorney for MBNA (listed as a creditor on my schedules and we even listed the law office as a collection agency) this past weekend saying they needed to speak with me - in reference to the debt itself. There wasa mini miranda on the letter too.

Is this in fact a violation of the automatic stay - and what recourse do I have?

Technically it IS a violation, but I'd let the lawyer handle it at this point.

MBNA is bad about turning the screws down hard BEFORE you file, won't settle, nasty threats, will tell you they have NO hardship program, etc... and then they'll want 'to talk' AFTER you file.. lol... they are SO pathetic !
