I had my wife's car towed to our mechanic's shop after she noticed some loud knocking and loss of power.
The mechanic said it sounded like something deep inside, like main bearings and said it would not be worth digging into it. Instead he would work up some quotes on replacing engine with a used one and for replacing engine with a short block.
About 2 days later he gave me a quote for $3800 (used engine) and $5800 (short block).
I told him I could not afford to have it repaired right now and that I would have to talk to our bank, etc., about borrowing the money.
He said not to worry, but that the car should not be driven and there was no charge for the quaote as he didn't do anything. He said I could leave it there as long as I needed to.
About a week later I called and said I was having problems getting the money together. Again he said not problem, the car was fine were it was.
I drive by his shop almost every day and could see the car in the front parking lot.
After about 4 weeks I decide to pick up the car as I felt guilty about keeping the car there. I stopped by on a weekend and discovered the stereo had been stolen.
I drove the car home - it did run very badly and sounded terrible, but it got me home.
Later that same day I got a letter informing me there was a lien on the car for $250 labor and $600 storage.
He said it wasn't his idea, but that the owner of the shop decided to place the lien. I told him about my stereo being missing and he said that several of the cars on the lot had been broken into over the past few weeks.
So...my question is: is he responsible to replace the stereo? My deductible $500) is more than the stereo is worth, but still if he claims I owe him $850, I feel someone owes me $500 for the stereo. Can I collect from him? Do I go to small claims court? Or am I outta luck?
