i have a question for you guys. i am involved in a custody battle for my 15 year old son. i am representing myself and the lastest trial date, the other partie's attorney asked for mediation. he told the judge we agreed on it. we did not agree. he told me it would happen anyway. the reason i am oppossed to mediation is that i don't think the other party will agree on anything and then i will have to start over. when i call to talk to my son, they hang up on me. they denied me visiation this weekend stating it was not my weekend. we have been doing every other weekend. i switched a weekend for them because they had plans and now that i am wanting to go by the schedule because of denied visistaion in the past, this happens. i am not sure if they will even allow it next weekend. they are extremely childish and rude. i can only pray that my son is not hearing them be so difficult. what my question is how do i find the form "order to show cause"? i have went online and found several for nc but not the one that i need for being in cotempt of court. also i would like to ask if i am required to mediation? please if someone could let me know, i would be so grateful. this whole case has been mentally trying on everyone.

if the judge said you two must mediate then you will have to...it is usually written into most court orders nowadays because parents should try to hack out what they can before getting in front of a judge who knows neither of you and then expect a fair and just decision....I found an order that has to do with visitation...I am not entirely sure it is what you need...let me know if it isn't and I will look some more. when you go to the free advice url...before you select anything look up at the top of the screen and it says legal forms...I typed in order and the 8th one down looked pretty good for your situation.
I wish there was something I could do or say to help you get through this...my boyfriends ex wife does the same thing...there just seems to be no justice.

thank you so much. i could not find the forms you had told me. i have been to the nc court forms and i find all kinds of order to show cause forms but all is child support,domestic violence, faliure to pay mediator, etc. i will try to find this form. this whole case has been so sad to watch. it breaks mt heart to see my own parents treat me and my son this way. he has expressed how he wants to come back but they say no with no reason why. we have a great home and family. he would do so much better here. his grades now are horrible and he is just going downhill. as his mother, i can't sit back and watch anymore. i need to get the orginal custody form i signed years ago overturned. once again thank you
