What is the name of your state (only U.S. law)? Virginia

In our CS order my XH is supposed to pay 59% of any left medical bills after I have pid $250 each year. Normally we prob wouldn't have to deal with this since my daughter isn't a sick child. However she had to see a specailist this yr. Things turned out normal and she doesn't have to return until next year.

However a large portion of this specislist was not covered. Plus we still have what 2 and a half months left of the year. And to make it even better she may now have to have her tonsils removed. Anyway I told him about the uncovered portion and he told me to let him know. My question is should I just keep like a "tab" and pay out everything first ( I mean liek the co-pays of $15 instead of asking for $8 every tiem we go to the Dr.) and the give it to him after 12-31? And in the mean time let him know so it doesn't come all at once?

your court order doesn't specify a time frame or limit? such as you have 15 days to notify him. and he would have 15 days to pay the amount?

i've seen alot of 30 days notice type when it comes to this issue. ity might serve you well to actually pay it yourself, then "bill" dad every 30 days. itemized. anything due since the last month would also be included.

Generally you would be expected to give him the information more promptly than that. Generally within 30 days of incuring the expense or receiving the final bill. You could probably save a copay bill to include with something else, but I definitely would not wait until the end of the year.

Read your court order. The proper way to do it is to give him proof you have met your $250.00 at the time you meet it THEN give him bills as you get them. How would you like it if the doctor held it all for the year and then sent you ONE bill for the entire year? And expected it within 20 days?

Gotcha. I reached a little over $250 and let him know (gave him the recipets and copies of checks for copays) and let him know before I took our daughter to the Heart Dr. that anything that wasn't covered was going to have to be split per the court order and then anything else she went to the Dr. (co-pays for sick visits and meds which normally totals $20 tops) I was suggesting waiting until the end of the year, simply because it is small amounts. I pay for everything up front since I am siging as the responsibile party on the forms, and he pays me. I have made him aware of the amounts just haven't said when he has to have it to me.

No there is no set time frame as to when hehas to pay it by. I honestly dont think we would have had this issue had it not been for her going to a specialist and the tonsils issue we are getting ready to have:(

My XH says he isn't paying any of it ($63.04) until I provide him with cleared checks for each item. the copays I can do that for but not medication. Do I have to provide that?

No you don't have to provide him with cleared checks. You have to provide proof of payment which a receipt is.
