No it's NOT hard to understand. Okay but then I don't know why there is such a thing as medical support if these dumbheads can go where ever they want. Why do we carry insurance if it does not have to be used. The system is a bit jacked.

This one isn't the system's fault. This one is the fault of a parent who doesn't care whether or not the other parent saves any money, even if it means that she is spending money unnecessarily as well. That is why you have to take it back to court.

The court order is what is 'jacked'. You've fallen victim to a loophole. There's nothing in the order indicating that mom has to use an in-network provider or pay 100% of the costs. It's a modification you'll have to attempt to get (or rather your husband will). Weigh whether or not it's worth the expense of modification.

Thank you - anyway I just found out that there is a 900.00 deductible to meet each year BEFORE they will pay 80%. NICE. Where if she had gone in network - to the doctor she orginally had picked for her daughter - there would not have been a bill.

the fact of the matter is she is trying to screw you, and she's doing it, and she will continue to do so until the order is changed.

Yes, this one is the mother's fault. However, the court order says your husband has to pay 50%. I would go ahead & put aside the 50% of the bill & then have your husband file with the courts. He should ask that if the mother does not use an in-network provider, that she pay 100% of the cost. And then ask that she be 100% responsible for ANY bills that currently exist since she did not use the right doctor. If he says yes, great, you keep your 50%. If he says no, give her the $. Then, in the future, she will have to use an in-network dr or pay 100%. Easily said & done. You most likely do not even need a lawyer to accomplish this.

Until there is a court order stating the only IN-NETWORK providers are to be used, she can go wherever she wants.

For an idea of what language to include, go to www.deltabravo.net and do a search for "comprehensive parenting plans."

In those plans specifically, you will find language that you could copy-n-paste into a modification that addresses utilizing in-network providers. THere is also other provisions with language that states about burdening the other parent with excessive costs, bills, etc. You might want to include that as well.
