Michigan Bench Warrant in Florida

What is the name of your state? Florida
I have a bench warrant in michigan, I live in florida. I was on probation for 3rd offense DUI. I had approx 1 year to go and had to move due to a housing/financial problem. I gave notice to my PO and he had my address of the place I moved to as well as the address to my new job. I had only two days notice to move. After three months living in florida i find out I have a bench Warrant for my arrest. My question is, If I get stopped in florida what are the chances of them hauling me back to Michigan? I just found out about this, and there is a money order in the mail for the balance of my fines/costs as I wright this. I had 1.5 years of probation to go, my PO said I could go, but I had to leave on two days notice and I have NOT recieved anything in the mail regarding this matter. Thanks in advance, Jimmy

My PO said I could go but it might take a month or two for paperwork, but I had no choice to leave on only two days notice to move

Your P.O. said you had to wait yet you went anyway ... and you are surprised that a warrant exists?

Probation is a favor ... a benefit. It allows you to remain OUT OF JAIL in lieu of following a few conditions. By violating those conditions you get in trouble.

So now, if you get pulled over you MAY be arrested and extradited. Even if you're not extradited, that warrant will be dogging you until the issuing court withdraws it (not likely without a court appearance or an attorney to straighten it out) or you are arrested.

what surprises me is why I havent recieved anything in the mail regarding this matter. and what was I gonna do? Live on the street in crusty Michigan thru the winter? By the way probation is not a favor. It is there because of all the dumb ass laws put so many people in jail that they cannot afford to keep all the people in there. Its there way to keep people in the system for longer periods and to make more money. Its also and excuse to get more funding for the various departments. Belive me if i had it to do again, I would not have pleaded, and took my chances at trial. I pleaded, got 1 year in jail big fines and this huge headache called probation. Had I been found guilty at trial, I would have gotten sentenced 1-5 and been out in less than 2 yrs, again because they cannot afford to keep everyone in there. I'm sorry for ranting, and I know your your a cop, but my experience tells me that law enforcment officers and dumb law lobbyists are creating an us against them attitude in our culture. If left unchecked will only make the world we live in a worse place, a vicious circle if you will. If I am getting pulled over for a tailight out, and thats it then that should be it. Give me ticket for a tailight, and let me go on my merry way. Not pull me over for a taillight, then try to get me for everything else humanly possible. (all 3 of my DUI charges stemed from getting pulled over for something else other than swerving or driving erraticly and was never in an accident, or harmed anyone, in fact one i was on private property and was sleeping in the back seat at a bar in the lot cause I didnt want to drive drunk) And all were .08 BAC, and I passed all soberiety testing with the exception of the ones that I can't do now even after not having a drink in over two years. Thanks for the advice, and do society a favor, give a break once in a while, and give out lots more warnings, and then pass the word to your co law enforcment people, and then protect and serve. I think youd be surprised at the results Have a good one, I may revisit this thread soon, but I have contacted my attorney. I swear your all in it together.

If people don't break the laws, that wouldn't be a problem.

Oh yeah ... they make all sorts of money on that. In my county in CA it costs a fortune tokeep people on probation - but it's more expensive to put them in jail. Hence, the reason they are on probation. But, someone usually has the option of refusing probation ... though I don't know anyone who would.

Not in my state. We don't get money from anyone for probationers. Maybe they get paid by the body in FL or MI, but not in CA.

Hmm ... okay. If you say so. But again, I'm not the one who has been accused and convicted of a crime. My job is to enforce the laws. If that means making an arrest for a warrant, so be it.

If there is nothing else to do, then that is all you'll get. Do you advocate we ignore other criminal offenses because the reason for the stop was the taillight?

"Ah, shoot, I pulled him over for a broken brake light - I guess I can't charge him for the decapitated body in the car."

If a DUI croses our path, we will (or should) deal with it under the law.

I have no compassion for DUI drivers. If they aren't DUI, no big deal. They get a ticket or a warning. But I would never gove a warning to a DUI driver and I would see that my officers are terminated if they even try.

Swear away, but we don't get paid for the bodies, and we sure as heck don't make money on arresting people. At least in CA we don't.

hmmmm let me see, i spend 40.00 for each visit with my PO. Each visit lasts 5 minutes at most, including the time it takes to put my folder back in the filing cabinet. I have two visits a month. I have a brain and a calculator, but I am no expert at math, in fact I suck at math. However if I figured right, at 40.00 for every 5 minute visit= 480.00 per hour @ 100% efficientcy ( can't spell worth a crap either) Cant tell me they are not making money. Even at 50% efficientcy they are still raking it in. Not including the fines, costs, fees, community service, jail time, (which I have to pay for also) 35.00 a day spent in jail times 1000 plus prisoners = $35000.00 a day. And thats just for the one county jail I was in.
LEGALIZED RACKETEERING IMHO.
And if you don't pay the fines?
LEGALIZED EXTORTION IMHO

I bet your gonna want a raise in salary now.

Since I don't live in your state, and I don't work for probation, it has no effect on me.

And they make you pay for your probation visits? Wow! I like that idea! I wish they would adopt that here as well. Since our Probation Department is cutting staff, something like that would certainly help sagging revenues and diminishing staff.

And even if it really did take ONLY 5 minutes per visit, I seriously doubt they are squeezing 12 people in each hour.

But, I'm not the one who will be living life looking over my shoulder.

I don't look over my shoulder ever. The officers here are really kool compared to back home, (after all florida is a red state and michigan is well a blue one)and I found out I am not worth the effort to bring back now that they have thier precious money. I cant get a license here until my time is up in mich (1.5 yrs to go on license suspension), however I can ride a moped legally, and it never snows here. My attorney has contacted my PO and was told that I should be able to settle this matter with little or no jail time. (of course will cost more money) And that I should contact him in advance of my return. Which wont be until my grandmother or father passes away (both of them are very healthy) and I have to return. By the way most times here they dont take you jail for driving on suspended license they let you call for a ride, impound the car, and make you goto jail at a later date. Seems to have cut down on the high speed chases dramaticly. Of course we all know that busting a guy for bad tags or a stolen car or (gasp) a bag of marijuana is WAY more important than the guy he killed trying to get away. ( I am being fecitious here) Anyway have a good one and I hope you are doing well. Jimmy
