What is the name of your state? Michigan

I have an excellent driving record. To lower my insurance premium, I chose only basic coverage. This week I was hit in a mall parking lot (I had the right of way and the other driver was speeding cross-wise through the parking lot). He admitted he "wasn't paying attention." Now I'm stuck paying $3,000 in damages to my vehicle. I have filed a claim against his insurance company, so I can at least get a deductible paid. Can I sue him in small claims for negligence? Thank you in advance for any response.

Yes. However, the police refused to come out and take a report as it was a non-injury accident on private property. I filed one the following morning at the station. Any advice?

I would turn it over to your insurance comany and let them handle it. They are more knowledgeable and have more resources to fight the insurance company of the guy who hit you than if you were to handle this on your own. Hopefully the guy will admit that he was at fault. These cases can get messy..
