What is the minimum time a person must make payments for in a chpt 13?
I have been told by my Bk attorneys legal assisitant that I must make a minimum of 12 monthly payments. I could then pay off the rest owed and be discharged.
Since then I have read on this board that the minimum is 36 payments.
1. Which is right?
When I filed chpt 13 I had a little over $40k in cc debt. Claims that were filed on my bk by cc companies equal about $20k.
2. Can an attempt to collect the other $20k be done after the bk is discharged?
3. My payback plan is 5.72% equaling out to 60 payments at $60 per month. Can this be paid off early?
Reason I ask this is I am hopefully getting more divorce here in the next 3 months. Some of the assets I hopefully will be awarded I can sell making up the $3,600.
4. Can I then payoff the bk with this money with out incuring a higher payback %?
