I am a 45 year old male, and S11 has lived with me for almost 1 year (shy a few days) without a single overnight at ex.

Ex no longer disputes full physical custody, just wants several dinners per month (such as Wed night for 1 hour)
Nor does she object to CS termination.

Still wants to have 50/50 legal with her getting the tie-breaker which means she will keep running the show. My lawyer proposed she gets legal to decide medical matters - doctors and stuff and I get to pick the school.

S11 goes to my school. We live 30 minutes away from ex.

I still pay child support since S11 started living with me to ex, who spends a token amount out of $1500/month and keeps the rest. I filed to have it canceled a year ago and the court rescheduled it twice already due to judges being overbooked. By the time the next court date rolls around, I will have paid for 400 days. But the really important thing is, S11 is where he wants to be and will have been with me for 400 days. Ex really abused him, in fact one time filed a false police report and ended up S11 getting arrested, put in handcuffs and taken to an Emergency Room, where the personnel decide that there was nothing wrong with him and he should be released to my custody. That was a year ago and the beginning of the end. She also put him a "behavioral unit" a few times as a method of punishment, where the put crazy kids.

The only thing they did in court yesterday was recognize that I have "de facto" residential custody, though it's not a court order. Not sure what legal force it has. I need a court order of course.

Do you have an attorney? Did the ER visit result in a report to child services? How was he initially placed into your custod if it was not by court order?

In as much as the ER visit was determined to be unnecessary, it seems that an attorney would argue against her having medical decision making.

The ER visit did come up in an evaluation by the court "custody evaluator" who pretty much dismissed it. Her findings resulted in: the child behaves the way it does and does not want to be with mom due to parental alienation and not due to mom's cruel behavior towards the minor child.
but you are right and the lawyer did emphasize this has to stop, hospitals, ER, police at her household at midnight.

The ex consented to S11 being in my custody, pretty much told me to come and get his things "until further notice" and that was a year ago.

You make a good point about medical decision making.

The real problem is I haven't gotten anything of substance on either thread. This one is a bit more promising and the other one got trolled with just noise. The car got steered into a ditch and not going anywhere.

Your problem isn’t the issues you are dealing with. It’s the fact your attorney doesn’t appear to be doing anything to get your issues in front of a judge. Nothing will be solved until you get a court to hear this so they can rule on the issues.

So, push your lawyer for answers as to why it hasn’t been heard yet and when he believes it can be heard

If not satisfied, seek the opinion of another lawyer who is familiar with the courts involved to verify or refute your attorneys statements and decide if you want to stick with the same attorney or if you should find one that can better benefit you.

Well, since you seem unhappy with the help provided (as you did when you were here several years ago), I'd advise you to consult with your attorney.
