What is the name of your state? Michigan- i was diagnosed with a muscle pull in my neck, my DR. sent me back to work with no restrictions, i build houses, after 6 months of shock therapy and meds that did not work i demanded an mri, mri showed ruptured c5-6 and i had to have an acdf with a donor bone and plate and screws. all this because he sent me back to work without knowing what was wrong with me, he should of ordered mri sooner i think any thoughts from anyone? ty lotz!
 


If you are sure the MRI read ruptured C5 and 6 then you might have a strong case. but before the anterior cervical decompression and fusion (ACDF) did you have symptoms such as numbness, loss of motor function(Weakness in the arms and legs), tingling and all? Were you evaluated pre and post operatively for both stability and neurological deficits with the JOAAS. ( Japanese orthopadic Association Assessment Scale).. Dont let the name fool you. the scale is used world wide not just in Japan....If yes what was your score pre and post operatively? Did they offer you laminectomy + dentate ligament section(DLS) as an alternative operation? there could be more to it than what you know. Most patients don’t often know the entire details of their case. If you want to run it by a review expert you could send your entire medical record to me including your MRI .

Was this a work related injury and a workers comp case?

yes mri did show rupture and the surgery was last week , and yes i had tingling and numbness and my elbow hurt so doc gave me a cortizone shot for tendenitis? he only let me have an mri as a last resort, and the only option the ns gave me was acdf nothing else was mentioned to me, now im in more pain than before surgery ty lots :(

Six months in construction is sufficient time to sustain a new injury. How can it be proven that the diagnosis of muscle spasm was incorrect, much less negligence resulting in significant damages that would not otherwise have occurred?

i seen dr 3 weeks prior to mri for same neck pain and he sent me back to work with no restrictions, now after suergery pain is gone . mri clearly showed ruptured c5-6 and obl foraminal canal. 1st he should of ordered mri from the begining 2nd he should of put me on restrictions when he did finally order mri cuz it took 3 weeks to get in to have the mri. so the 6 month window is now a 3 week window and he knew i was in pain and still no lite duty until after mri ,1st thing nuro said was why are you working, bottom line is there never was a strain issue , there treatment only aggravated my problem, even tho u say 6 months is a long time to get a new injury i wouldnt of gotten a new injury if i was on restrictions because i would of only been pushing a broom

Also, as ellencee asks, how can you prove that the injury was a result of going back to work? You need to take your info and chart to a med/mal lawyer and have it reviewed. You may/not have a case, but there seems to be something missing in your responses. I am remiss to understand your response that the Neuro surgeon did not explain or offer alternatives and you are concerned about the problem now, and the 1st tx MD care, but did not raise these issues prior to surgery....

The poster does not mention what symptoms were present when originally presenting to the physician. Much of the treatment plan for such problems comes from clinical presentation, not just MRI's and / or other diagnostics. In fact, clinical presentation is the first line in diagnosis. Standards of care in virtually any of these situations will be conservative types of treatment, just as the poster describes. Subsequent MRI's or other diagnostics cannot relate when an event occurred. To think that this individual definitively had the condition shown on the later MRI's at the initial presentation is unfounded. By the same token, I have seen appropriate surgical decisions made based on clinical symptomatology when MRI did not seem to warrant the same decision. Lastly, having worked in a neurological and trauma intensive care unit for 5 years with some exceptional neurosurgeons, I've never heard of this Japanese whatever scale. Not that it may not have validity, I simply think physicianreviewer has some ulterior motives by having read several of his / her replies. lkc15507

i found a reputable lawyer ,one that is very good. seems to him that my primary sent me into a dangerous situation in an environment that i could have been kiiled in, when i should not of been there ,knowing i had no reflexes in my right arm, and that i had shooting pain down my right side of my body, he wanted to save insurance company money cuz an mri is 5400 dollars. now i had the surgery and now both sides of my body are in pain and tingling, so the ns is in a heap of trouble if this dont go away, i got em both by the ballz so yall should look up a new hobbie cuz your advice sux lmfao
