Colorado - I purchased a house 18 mos. ago with the understanding that the house was built in 1955. When I received my tax valuation statement from the county assessor the statement showed my house was actually built in 1944. Isn't this considered misrepresentation? Do I have any legal recourse since they sold me something other than what I thought I was buying?

Did you use a certified appraiser?

Did you receive the appraisal report?

What "year built" did the appraiser write on the report?

What does the County or City Government have on record for "year built?"

Let me redo that last question, to help you understand it better.

The county could of made a "typo".

The 4 is right next to the 5.

Call the county ask when the building permit was issued, if known.

What year was your neighbor's houses built?

If you find out the county is wrong, you might "let sleeping dogs alone." You could find yourself paying a higher tax on your property.

My realtor claimed house was built in 1955. My appraisal also states 1955 because he received his information from the realtor. I confirmed with the county assessor that the actual build date is 1944. That's an 11 year difference and in my opinion would significantly reduce the appraised value of the home at the time of purchase. Is the realtor responsible for confirming this information or do they just go off what the seller says?

How did the county assessor confirm?

What year were your neighbor's houses built?

Call your appraiser...tell him the situation and ask him where he got his information.

Where did the listing real estate agent get their information (county, builder)?

So whats your Beef?

So what is the issue with the house?. How does the year built change what you bought. You bought a house on land are you damaged some how by whether it was built in 45 or 55?

Here's an idea......

Hire a different appraiser. Will cost you $300-500. If the new appraisal is lower than the first one, then there is your $$$$ for damages.

Does that seem logical enough?

I would still like to know when your neighbor's houses were built?

One neighbor's house was built in 1920 and the other in 1896. This area is considered rural and unincorporated so we're not talking about track homes. If it does come to pass that the realtor made a mistake does that mean I would have to have my mortgage redone?

Dear North Fork Pa:

What written document that you have in your possession and have had in your possession since before the closing gives the incorrect date of the building of the house?

both the MLS flyer and the appraisal report state the wrong build date. The county assessor tax statement lists the correct age. Could this make a big difference in the actual value of the home and if so I assume the amount of interest paid on a 30 year?

Q: Could this make a big difference in the actual value of the home....

A: Only an appraiser could answer that question.

Didnt you think you were buying a house? How relevant is this build date?
Do you want out of the deal?, want your money back?, is there some problem with the house. Would the construction be different based on when it was built? How is the House constructed i.e what methods (frame, brick)?? Does the house look like it is all original construction or some old and perhaps some newer or added? Perhaps construction was begun in 44 and finished in 55, is that likely?
Please Provide more information.
