missing despoit money

What is the name of your state?Nevada
I moved in to my apt (condo) which is individually owned, about 2 years ago. I was told I only had to pay $200 for the deposit, when I could make payments on it. Next day, I paid the $200, and my rent was already taken care of as well. About 6 months ago orso, my landlord sold all of his units. Recenently my new landlord, after being asked by me about why the exterminator never comes here, and why the bathroom repairs have not been met, he mentions that I never paid a deposit. So, I made him copies of all of recietes. He then called the oold landlord and asked him about it, but the old landlord says it went for rent. Which is a lie. So at this point, I have paid $500 in to a deposit that can't be found. I have tried calling my old landlord myself several times, but so far he won't even return my calls. My new landlord says It is up to me to get a print out from him and to see where this money is at, or for me to take him to small claims court. How is that up to me? I know I paid it, as does both landlords. So isn't it up to teh new landlord to find this out? Also, they still refuse to fix the repairs that need to be attended to. :mad:

As long as you have reciept showing the payment made . your new LL still must give you credit for it . It is not your fault that the new LL didnt get the correct records from the seller with credits for deposits paid . The other thing you mention about with repairs not being made . Stop using the phone to complain about them use written repair request letters sent with at the least a certificate of mailing so you have proof of mailing it . and keep a copy . your recipt is considered a paper trail since it is proof that you paid it so will the copy of the letter and the certificate of mailing reciept you keep help give you a paper trail . Do you have a written lease ? If so what does it say about repairs and also wether it transfers with the sale of the property ? If your only a month to month renter and the LL wont make repairs you might be better off looking for a new place and giving proper notice .

I had something similar to me happen a couple of years ago where I had put down a $500. deposit . when I moved out I even hired someone to come in and clean the apartment, It spotless when I moved out. When I requested my deposit back I was told they had no record of my paying a deposit . unlike you I did not still have my original receipt, but I was also able to get copies from my bank of the check I had wrote for the deposit. Luckily on that check I noted it was for deposit.
Along with the receipts if you paid by check call your bank and see if you can still get a copy of the check just for extra proof. Your receipt should be enough but it is always smart to be well prepared.
