I am unsure if I am on the right board, someone tell me to move it
if I am:)

I have a friend that quit his job suddenly. He took his uniforms in
and was told by his boss which is also the owner of the business
that he would compute his wages and issue one check (he was due two weeks pay). He called his boss today and was told he
was missing three pairs of pants and a jacket and wouldn't be
getting his last check until the missing items were turned in. He
swears he doesn't have them and they are put in a break room
where everyone has access to them after the cleaning company
washes them. Can his ex boss really keep his earned money
for things he can't actually prove were kept? How should he proceed? All advice will be appreciated.

My response:

Throw the issue back into the employer's lap.

Tell the employer that you did turn the pants in, and to prove otherwise.

Tell the employer if you really want to push this matter over the value of 3 pairs of pants, tell the employer you'll gladly oblige him, and get the EEOC involved, and take a chance with paying fines for non-payment of wages, and also take him to court for non-payment of wages and "treble damages", and he can have the good fortune, and opportunity, to explain his reasoning to a judge and to prove that the pants are missing, and are your responsibility. You, on the other hand, must maintain "the party line" in this matter, by saying that you did, in fact, turn in all of your uniforms, and that the burden is on the Defendant employer to PROVE otherwise.

Ask the employer, "Is the value of 3 pair of pants REALLY worth all of the hastle I'm going to cause you ? Now, send me every stinking penny you owe me, or you can explain yourself to the State, and to a judge."

and the guy told him to come in at
1pm today and they would square
it all away!!!!!!!!! You're grrrreat!
