Mistake on Speeding ticket

What is the name of your state? South Carolina

I was driving South from NJ to Fla, at 1:30a.m. when we were pulled over in Colleton County, SC on I-95 for going 85 in a 70.

After looking at the ticket, the officer indicated I was heading North on I-95. I have proof I was heading South because at 2:30a.m. we checked into a hotel off I-95 in Fayettville, Ga.

Can I fight this ?

Sure, but a clerical error on the officer's side does not eliminate the fact that you were going 15 miles over the speed limit.

You're right. I as going faster than the posted limit. I don't always consider that speeding. I commute 100 miles per day on (65MPH) route 80 and drive 80mph with cruise control and don't have to brake when I see police. 15 mph is not enough to get pulled over on a highway in NJ.

I guess based on my experience I thought 15mph was within the limits of "street legal", so yes, I am going to try to beat it.

You've got a few problems with your defense. First, it's one thing to be going 75-80 mph along with all the other worker bees at rush hour. Your staying with traffic, and not causing a probelm by putting along at a paltry 65. It's a whole other thing to be zooming along at 85 when there's very little traffic. It makes you stand out. And the yankee plates didn't help matters.

But, if you want to protest, go right ahead. I can just see it now, "But Your Honor, I go faster than that every day up in Joisey and no one ever stops me." If you're lucky, he'll be laughing so hard that when he throws the book at you he misses.

Actually, 0 MPH over is within the limits of "street legal" That's why it's the speed LIMIT, not the "please try to stay below this number."

Feel free to drive faster than the speed limit, as it is generally safe, but realize that by doing so you'll open yourself up to tickets like this.

Next time buy a radar detector...

Why do you think the troopers on I-95 are always the ones with the most tickets? Usually in SC you will get 10mph on the interstate but that is all regardless of the traffic.

Based on a lot of other posts NJ is also getting tough and 20mph over in VA will now earn you a reckless citation so it is not just SC.

The judge will not discuss the ticket with you so the only way you can fight it is to show up on your court date or retain an attorney.
Either way the ticket will probably only be reduced to an under 10mph citation.
