The landlord, by including the multiple (3-4) air conditioning units in the new lease agreement, would be committing to maintenance and repair for each of the multiple replacement units. Tenants sometimes can be vindictive in causing maintenance issues when in disagreement with the property owner. Check for a reputable landlord protection association for the specific documentation related to tenant maintenance responsibilities.

The new month-to-month lease agreement should state that the tenant is responsible for maintenance and repair of air conditioning units provided as courtesy by landlord. There is no reason to mention the air conditioning units at all in the new lease agreement, except to ensure that the air conditioners units are not removed by the tenant upon the vacating the premises at move-out. (The same reason the refrigerator, range oven, stove top, wall oven, microwave, carpet, etc. are specifically mentioned by brand and model in lease agreement.)

I want to thank you all so much for your advice and help. My brother, who is an attorney, has proofed a modified online lease type document called "Change of Lease" which I will CCR USPS to the tenants. The cover letter states that if they are not agreeable to the change, they are free to give their 10-day notice and vacate.

I really appreciate the information and advice I received here. As a bookkeeper/tax preparer, I am very grateful to not have to go to someone for work I know they will not accept payment for without making it as streamlined as possible. With the advice I received here, I was basically able to construct the document myself, email it to my brother, have him do a quick once-over, make the 2 changes he recommended, and am good to go. Thank you all so much.

P.S. Central air is specifically excluded; window units (new, energy efficient and specific square footage of cooling stated) are named and tenant is responsible for normal maintenance; the free perks tenant is given (and has been for the past 17 months) are stated but stated as perks at the landlord's pleasure (not required to reboot the router on demand for the tenants free wireless internet, if brand new washer dryer provided as a favor at their hookup die, we are not responsible for replacement, etc.), stated month-to-month but requires 30-day notice from either party.

P.P.S. After reviewing the email chains, brother advises to actually dump them ... that tenant wife appears to be trying to get me to evict them because she wants to move and tenant husband does not want to. I tend to agree; however, we are in no rush to take over the unit. When unit is taken over, MIL will take it over (she lives with us currently) and renovate. She'd like another 3 months or so to get her ducks in a row, then do a complete remodel. So, any damage would likely not be a real issue as it would be redone even if it were in perfect condition.

Update:

Tenants paid rent on-time on the 15th, so appears they accept the Change of Lease. Still have not received the confirmation of delivery on that CCR, but it was also hand-delivered and have my copy of the USPS receipt showing CCR was sent, so I don't anticipate any problem.

Advise them you are giving 30 day notice to vacate, as you feel property needs renovated and you cannot do that while it is occupied. It appears wife is whackjob intentionally seeking attention and who is willing to damage the property to get it.

Apologies if updates are necroposting. Update: There were no further issues after modified lease and the tenant remained another year with no issues except a snooty wife-tenant. That didn't bother me, so no biggie.

MIL has taken over the house and remodeled. I have moved Mom (declining) into a 2 room cottage right off my back door that has once been an office/guest house to be better able to care for her. We have 1 remaining set of tenant renting a mobile owned my my mother that we moved onto our compound. Figured less problems if we are on site.

Things going very well and am blessed to be able to care for my mother ... then MIL. Thank you for your assistance.

Thank you for the update. We rarely get to know what eventually happened, so its nice to know in this case.
