Mobile Home Park Issues

Carver County, Minnesota -

I currently live in a mobile home and lease the "lot" the home is located on. The lot is on the edge of a hill and this hill has started to erode into my home, I fear there is serious damage to the rim joists (bottom outside wooden framework of the home) as my back bedroom floor gets wet every time it rains as the hill itself has eroded enough to become level with the floor inside (about 2' above normal ground level)

I've read every statute I can find about mobile home parks, but I am unable to find anything dealing with this type of situation, the best info I can find basically says "above ground is the tenants, below ground is the landlords) I would rather know the laws

I'm trying to figure out what the statute is before I even bring this up to the park owners/operators, I've heard working with them is like pulling teeth, so I would rather be prepared.

(3) No manufactured home shall be located closer than three
feet to the side lot lines of a manufactured home park, if the
abutting property is improved property, or closer than ten feet
to a public street or alley. Each individual site shall abut or
face on a driveway or clear unoccupied space of not less than 16
feet in width, which space shall have unobstructed access to a
public highway or alley. There shall be an open space of at
least ten feet between the sides of adjacent manufactured homes
including their attachments and at least three feet between
manufactured homes when parked end to end. The space between
manufactured homes may be used for the parking of motor vehicles
and other property, if the vehicle or other property is parked
at least ten feet from the nearest adjacent manufactured home
position. The requirements of this paragraph shall not apply to
recreational camping areas and variances may be granted by the
state commissioner of health in manufactured home parks when the
variance is applied for in writing and in the opinion of the
commissioner the variance will not endanger the health, safety,
and welfare of manufactured home park occupants.

with the info EN posted consider contacting the countys zoning dept and have them look at the erosion problem and see if they are able to assist. If you are not able to get any where then you may have to consider trying to purchase land perhaps in Mcleod or Sibley co where they may be more lax about people setting up used homes. I would bet that Scott is now as suburban looking as parts of carver co are and likely too restrictive about used mobile homes being placed anywhere but a park. Take the time to speak to a real estate atty , If your on a long term lease a real estate atty can tell you if this fits constructive eviction , and best advise you of what your options may be. Ill bet most of Carver co still is served by indep phone cos wich means the phone book listings are going to stink as bad as they do up here in Mille lacs co . Try the links up top when you are ready to consult with a atty even if you had to pay a small consult fee. it would be cheaper than allowing damages to your home to get to a point that the home is structurally no longer sound to live in.
 
Yeah, I've got 22 feet on either side of my Mobile Home (MH) I haven't measured, but I'm quite far off the curb, and I don't have a neighbor behind me.

Here's kinda an idea of what I'm talkin' about, the dark line in the middle of the hill is where the MH park's property line is at, and on the other side of that line is an empty lot. The dark blue is the MH itself, the light blue is the skirting.

Does the lease address anything along these lines? (Not trying to be sarcastic...)
 
unfortunately the Lease doesn't say anything about the land the home is on, other then it needs to be kept looking nice (mowed, raked, etc...)

I've looked it over several times. One of the neighbors said there's an attorney who works with a mobile home park non-profit orgnization that helps residents of mobile home parks fight for their rights, who may be able to help me figure this issue out.

Like I said before, I don't want to make a HUGE stink about this to the management - I just want the issue resolved ...
