My mother and I signed a rental ageement fourteen years ago for a home here in Alabama. My mother has lived in this home for the past 14 years. Mom is now ill and we would like to move her to another home as the home she is currently renting is not what we would like for her. Her current lease should have been up in April of 2007. We did not resign the lease. I would like to give 30 days notice to the landlord that we do not plan to renew, but I was told that I would have to renew because the lease is up in April of 2007 and I only gave notice that we did not plan to renew on April 24th. I was also told by another landlord that in the state of AL, if I have leased a home for more than 10 years, that my lease automatically renews for month to month lease. My understanding of this is that if I turned in notice on the 24th of April then I am responsible only for the month of May and that is it. I have not been able to locate this law myself, but I would like to know if this is actually true since the landlord is stating that we are responsible for a full year even though we never resigned the lease.

Some states, such as Kansas, renews a year to year lease automatically for another year if notice is not given that they do not plan on renewing and are going to move. I could not find that in the Alabama laws so I just assume it goes to a month to month tenancy. Now according to Alabama a 10 day notice is all that is required to break a lease.

You would be accountable for the month of May, Unless landlord rents the place out before the end of May in which case you would be entitled to a refund of the difference.
