Mom to, unrightfully, get PTI for steroids posession. Can we fight it?

What is the name of your state?What is the name of your state? This matter occurs in NJ. My mom is being charged with Criminal possession of a Controlled Dangerous Substance after the police came to the house where my mother and I reside, on a warrant for myself. She (Mom) does own the house where this takes place. The police knocked, then without permission, while I was still in my bedroom out of sight, barged in at the first crack of daylight. If memory serves me properly, I will have to ask Mom for exact occurrences of the night if these are important.

Otherwise, she is arrested for obstructing justice- preventing an officer of the law from doing his duty. She would not tell them where I was or anything of the sort, but she did not become violent or abusive in any manner. The problem at hand became realized when they searched her pocketbook at the station and found 3 pills of dianabol (d-bol's on the street) an illegal steroid. These were obviously not her pills. She had picked them up one day in order to prevent either one of our animals or some kid from picking them up, only they were never properly disposed of. The prosecutor has even mentioned the intent to distribute, which is ludicrous.

Three pills and they are mentioning distribution. What is the NJ law for steroids and position in order to imply guilt of distribution of steroids?

She has no prior record at all; I think there is one mark on her record for not complying with the dog license regulations in the town on time. This, along with a single speeding ticket, years ago, for a women in her 50's. There must be another way besides PTI. The probation visits and drug tests are humiliating for a woman who has done nothing wrong. She stood up for me, her son, in her own house and will have to endure years of blacklisting until the court decides to remove it from her record. I have not even mentioned the cost, which this has and will endure on her, monetarily, emotionally, and physically. There must be a way to fight this and prove these are not her steroids.

UMM.....She "picked them up" where??? Home? The subway? The neighbor's?

The thing is I have been around them before, I knew exactly what they were when she told me what they looked like as they were sending them off to the lab to be tested. I had none at the time.

She does not remember where she picked them up at exactly. Possibly in the house, at work or around. She has a habit of leaving her vitamins and pills(prescriptions) lying around. She picked these up in order to prevent anyone else from being in danger of taking them, dogs, kids, etc...

Is there considerable legal help on the site? We are attempting to work out this problem without creating another. We have already gone over the possiblity of these being mine, I have been as open about steroid use as Jason Giambi. It's no secret.

So once again, what is the solution? Should she fight and bring it against a jury?

Start this discombobulated story over from the begining and be honest.

Why did SHE get obstruction when they were there b/c the pills were in HER purse?
Why did they ask about YOU when the pills were in HER purse??
Why didn't YOU come down and take ownership THEN???

You could have saved dear old mom alot of trouble then if you had owned up. NOW you want to, and I think it may be too late. Wait for a person better versed in the law to answer that one for you....

I had my own problems. Driving suspended and other such stuff I have since cleared up became a problem because I had missed a court date and they were there to make sure I made the next one. They had a warrant with my name on it. I had no idea about the pills, neither did she, neither did they. The police arrested her for not cooperating with them on the warrant. She then asked them to get her purse so she would be able to bail herself out, her checkbook was in there. So the police got her purse took her down to the station and searched her bag. They then found the steroids. There, thank you, I had forgotten to print these details.

This is the point which makes it even harder to believe she was hiding anything. Why would she ask the officers to get her bag when they were no where near it.

How did I make a story spin my way? This is the way it happened. I stated explicitly in the first post and I quote,"What is the name of your state?What is the name of your state? I Do not know where she picked them up for sure. The house is only one possibility, she worked with guys who may have dropped them at the office. Otherwise, I do not know where they could have come from. She does not remember where she picked them up at. If it was the house, who knows friends could have dropped them at the time. I knew people who had taken them, I used to take them years ago. Not at the time either, or this could have obviously been a possibility.

Get a lawyer and save your truth for them........................why were youe taking illegal drugs?

To get bigger, stronger faster. But, the reasoning behind why I decided to take a physically enhancing drug, like millions choose everyday to lose weight by taking a presciption drug which later is found to cause braing tumors or when any women or man decides to have plastic surgery to simply enhance their physical status, is irrelevant. We have all made decisions in life which we livewith each day, the most beneficial decisions we learn from. Some agree and some disagree, http://www.cnn.com/2005/ALLPOLITICS/02/21/bush.tapes/. I am a recovering Alcoholic/addict. I have learned much from the experiences in my life. Should we try this in front of a jury or not?

If it were me, I would take it to a jury. I doubt it would ever get close to that. No jury is going to convict your mother of distributing steroids for three lousy pills. I doubt the state is going to waste taxpayers' money to take it to trial.

If your mom clearly does not remember how these pills ended up in her purse, let alone not even know what they were, why would she plead guilty to something she is not guilty of? I would take it to trial (even to possession). Like I said, I doubt very much the state is going to let it go that far. If anything, they will probably give her probation. I can't imagine it going very far, especially with her clean record.

Are you serious? She has the pills in her purse. She will have to explain how steroid pills got in her purse. The defense of "I do not remember how they got in my purse" and " I didn't know they were steoids" will result in an easy conviction.
