What is the name of your state? New York

I am 19 years old, I work full time and go to college. My mom and I were evicted two weeks ago because she wasn't paying rent. I had no idea that this was going on. I thought we were doing ok. Well the landlord took all of our things upon eviction. I have no idea what to do and I need my things back, especially my computer since it has all my school work on it. I have my final project due in 4 weeks and all of it is on the hard drive. Also my name was not on the lease, i know that for sure. What do I do to get my things back? At this point since my mom has done me wrong, as bad as it sounds I do not care about her things. I appologize if that sounds nasty, but she has stolen money from me and lots of other things that would take too long to explain. Long story short I have tried to contact landlord and I know where my things are but he said I can't have them back until she pays him all the back rent. What do I do? Please Help!!!

according to http://www.tenant.net/Rights/atgrent.html, "When a tenant is evicted, the landlord has no right to retain the tenant's personal belongings or furniture". another part of the document says to go to the police station and demand an officer accompany you to the premises to demand access to your belongings, as noted here:

What Does the Tenant do in a Lock-out Situation?

1. The tenant should go directly to the local police precinct.
Dialing 911 is not adequate!

If the officer on duty is not responsive to the problem, the
officer should be referred to Police Guide Procedure Number
117-11. If the officer is unaware of the law or is unwilling
to respond to the lock-out, the Desk Sergeant should be
contacted.

2. The tenant should not leave the police station without being
accompanied by an officer back to the premises.

3. If additional advocacy is necessary, a community
organization or legal services office should be contacted.

Thank you I will try that first thing tomorrow morning. I am at work right now until 9pm tonight, so that won't do me any good. I will take that advice and go to the police station tomorrow. I'll let you know how things go.

yes, let us know...

Just a tad bit of extra info...

In my state, a LL MAY hold personal belongings, but they(LL) CANNOT hold items used for a persons work, education, or clothing. In other words, if they are holding school books, computer, clothes, suit for work, your trade tools, etc., the LL MUST release them to you.
