more rights to custody if there is proof of alcoholism?

What is the name of your state? CA

Will I have more rights to custody of our child if the reason I left him was largely due to alcoholism? He sought medical treatment for alcohol induced hepatomegaly three months after our separation, as well as psychological counsel for addiction behavior and depression. Our daughter is three years old. He has now been sober for six months. Does that make the original question null? He still has problems with emotional instability and depression. He is working as a bartender.

An admitted alcoholic...who is on record as having sought recent treatment for that and other disorders...who is working as a BARTENDER? Who has only been sober for six months?

Hon, he can't get custody....not unless you have even worse problems than his...and in that case maybe neither of you would get custody.

It will when he raises your mental health problems as in quid pro quo and your history. IF clean no worry if your not I wouldnt bring it up.

What mental health issues?...What basis do you have for making that statement? You are new here....it might be to your benefit to sit back a bit and read. Please don't take that as a "bash"...despite the fact that you have chosen to bash me.. :D Its not intended that way. :) However this board deals very strictly with legal issues and so far your understanding of those appears to be a bit shaky.

Actually L, I have to agree with ENASNI, I think we have a new troll. All over the boards all afternoon spouting nonsense.

Thanks for your input, I am sooo new. What you all say is reassuring, but am I within the limits of the law? The only PROOF I have is his medical records (which would have to be summonsed) for the treatment. Other than that, it's all verbal. Myself, I have no "mental health issues", the only thing is the counseling I sought to help me with leaving him. But I am very clean.

As far as emotional soundness, there is no real proof other than his counseling for the addiction...and depression. And really, he hasn't admitted to the addiction, but his doctors have told him he's there. (duh)
