Mortgage in only one person's name

My boyfriend and I bought a house together (splitting the costs), but due to issue with my job, only his name is on the mortgage. Since the mortgage is in his name only, he doesn't want to put me on the title. What options do we have to ensure we can both claim ownership? I have drawn up an agreement stating such and he has signed it, but I didn't know if we need it to be witnessed by a notary to be legal or if it would even hold up in court.

If your name is not on title, you have no claim to the house. The amount of money you are paying to help with the mortgage is essentially a rent to your boyfriend.

No, but we want to know how to make it so that I do have a legal claim to the house without adding me to the title or should I be added to the title and then draw up an agreement so that specifies that I am responsible for half the mortgage.

You cannot be added to the DEED unless the mortgage holder agrees and they won't. Any agreement without the mortgage holder's approval is worthless.

Talk to an attorney. It may be possible to have your BF sign some type of jr. mortgage that guaranties you your Down payment plus a percentage of appreciation.
