What is the name of your state (only U.S. law)? Texas MY mortgage co. sold my mortgage to another co, The deed is held by MERS, apparently not recorded at county(Collin) When I pay my mortgage off will I have trouble getting the deed, and who would have the right to foreclose? How and why would MERS have your deed? Your deed is the one the seller used to transfer title to you. Are you sure they don't have a trust deed? That would have been a deed from you to a trust (a method of the lender holding the title while you are paying the mortgage loan.)
