:( My husband lost his job in December 04 and just now got a job last week. We are several months behind on our mortgage. Nov, Dec, Jan and now Feb payment is about to be due. I don't see how we will be able to catch up on our own. Does anyone know anywhere we can get assistance. I am so afraid that they are going to take our house away. I have tried different avenues and none have worked. The mortgage company is not willing to work with us. They have asked for at least half, but we can't even come up with our electric bill hardly. This is our first home and we have lived there 3 years. I just don't know where to go or who to turn to. Any advice would be beneficial. I once heard that by GA law - If we were to send partial payment/some money by mail and then they refused it and sent it back to us, that month was considered paid for and we could deposit that money back into our account by GA law. Has anyone hear of this? If so, does anyone know where I can get it in writing? Thanks

Hi, I am not an expert - but that does not really sound right. Do you have an FHA loan? You can go to a HUD counselour even if you do not have one. I would see if there is one in your area who will hepl you put a plan together - listing why you got behind - why you think you will now be able to keep up with payments and an offer of when you would be able to begin paying again. If one person is not helpful at your mort. comp. call back and get someone else. I feel for you - we are in the same boat only worse!

Once you are in default, the lender does not have to accept partial payments.

Christie,
sometimes charities (e.g. catholic church charities) will help out in those situations. I don't know for sure about mortgage payments, but I know of some cases where they helped out with rent. I would try and call, even if it is a long shot.
