I recently found out that my mortgage payment was increased from 508 a month to 750 a month without ever being notified by the company. I contacted my mortgage company and they stated this was due to unpaid city and county taxes for 2004. The escrow amount was for 1400.00 dollars and my taxes are only 723 yearly combined. They told me that it was for 2005 taxes as well. Is this legal can they really charge me for a year that is not even over yet? It looks like a collection company that is dealing with the city and county taxes contacted my mortgage company and requested a payment, They never even contacted me either to maybe work out a better payment plan then what my mortgage company has offered, they just went for the gold and we might lose our home because of it. Now I contacted my mortgage company several times and all the times I spoke with them they stated they would put me on a 36 month plan reducing my payment to 631.00 a month so I took that plan since it was lower. Now the fun starts. I paid my November payment of 631.00 then I get a call in December stating I did not pay the payment in full and I am behind. They never put me on the 36 month plan as they said but accepted the payments on the 631.00 amount. Then I thought I had it all worked out and they accepted a payment of 631.00 for December. I get another call two weeks later telling me that Decembers payment was short because my payment is 750 I said what I was told about the payment plan and again they so called straightened this out. Well this is still going on. I spoke with a supervisor and he stated he would take care of it well I never received a phone call back from him but spoke again to customer service and they transferred me to a so called supervisor who stated I am one month behind and did not recall a payment plan because it is not in the computer. He then stated he saw where they had me at 36 months to pay the escrow and then the changed it back to 12 months. Im still going through this and they will not admit to their mistake and I am getting the run around. Anything legal I can do about this? Any advice would be helpful.

Get off the phone! Start writing them letters and demand that they do the same. Unless you get some of this in writing, you may have no recourse.

If your mortgage company is set up to pay taxes from an escrow account, they will pay them when the bills come due. If the bills are in fact valid, then you owe the money! If there is not enough money in your escrow account to pay the taxes, then the bank pays the bill anyway and expects you to pay them back by increasing payments to the escrow account. This is essentially a free loan that you are paying back over 12 or 36 months. They also expect you to pay extra into the escrow account so that the next time taxes come due, there will be enough money in there and the bank won't get screwed again.

This is all standard practice and its better than the alternative of you having to pay the taxes directly and getting penalties for not paying on time. Don't be rude with the bank for giving you any opportunity to pay over time.

Thanks for the advice I am going to start demanding everything in writting. Trust me I am not being rude with the mortgage company well not trying to be. I can understand they are doing everything they can to protect their intrest. But when I contacted them they stated they would put me on a 36 month plan and accepted payments over the phone for the amount we agreed upon 631.00 but this was all of a sudden reversed back to a 12 month plan with no explanation making me past due. Payments I made on my home for 631 were split to pay prior month payments at 750.00 dollars. Not knowing to me that this was happening until the collection department calls and informes me that I did not pay enough on my last months bill. When I call back I get ohh this is not in the computer I see nothing from all of your 10 calls to us. This has been happening for months to me and all I get from them is the run around. Trust me rude is not what I want to be I just want a straight and honest answer.
