mother in law took child need help and advice

over the weekend my daughter went with her grandmother and stepgrandfather to the lake like she has been doing for months on average of every other weekend. they told us they wouldnt be back till Tues. On Mon. night they called my wife and i and told us to come over and "we needed to talk". when we got there they gave us a paper stateing that she had been "appointed temporary guardian" of my daughter and her "estate". my daughter is 1 yr old. they had apparently spoke to a lawyer durring the day and saw a judge who ordered this. I have 2 questions regarding this. 1. The date on the paper is 26th day of June, which is a Sunday. It is stamped on being filed on the 27th. Is this legitimate? 2. We were told that we were going to be served on Wed. How can they take our child when we havent even been served? It gives a date of a temporary custody hearing, but no time. Her mother is useing the fact that my wife is bi-polar against her, yet she is bi-polar herself. plz help.
 


what do u mean "crock of crap"? is this not legal? i did call the cops and they said that since the paper is signed by the Circuit Judge that there is nothing they can do. :(
 
the only paper work i've seen is the paper she gave us. i could type the whole thing out if you'd like. other than that we have nothing till we get served on Wed.

Yeah but theres got to be something else going on because why would they just up and take your kids...obviously if they did get paperwork they had some good evidence to show the judge...what are you not telling us?
 
she had stayed with my wife's grandmother last week becouse my wife and i were sick and contagious and we didnt want her to get sick. i suppose that has something to do with this too
 
other than that thats all i know. im telling you everything ive been told and that i know. i know there is something that they're not telling us but we dont know what it is. is all this legal tho?

They are probably afraid that once you turn yourself in for being AWOL your wife will be unable to care for the child alone.
They obtained an ex-parte order which is never an easy thing to do. Somehow they convinced the judge that the child was in immediate danger.
You both need to go see a good family lawyer TODAY. If you don't have copies of the paperwork go to court & request a copy. You'll need to bring that with you to the consult...along with a pretty substantial retainer fee.

legalcuriousity - the grandparents likely had an emergency ex parte hearing over the weekend.

OP - expect that the grandparents will bring up your status with the military when this goes to court. So you'd best make sure that you tell your lawyer about it, before s/he gets blindsided in court.
