UPDATE of this ONGOING SAGA:
Mother has now filed for full custody. Judge made an order on Sept. 8th. that she cannot take child out of state unless permitted by the court or in writing from the father. She did not appeal within her ten day statute of limitations. Indictments were handed down on our Sept 8th court date but no documents were available at the time to prove this. I do have them now. She is being charged with 2nd DUI in ten years with a BAL of 0.08 or higher, aggravated manslaughter and involuntary manslaughter. I will show the judge these indictments and tell him if she can't make a important decision as an adult how can she do it as a parent. I think she is grasping for straws because she knows she is going downhill fast.

News Update:
Mother was convicted on April 13th 2005 of 2nd DUI and manslaughter. Sentencing will be July 12th. In February she filed for support increase. Our hearing is May 31st. I am awaiting the court order on her conviction in which she had to hand over her DL to the courts. She also has to check in with a correctional officer. Not sure on the details about that yet. Once I get the order I will get my lawyer to file a motion for full custody and hopefully get it all continued after her sentencing. Depending on what my lawyers availability dates. Also going to subpoena the toxicology report that showed a BAL of .123 and tested positive for marijuana use.

Im so sorry that someone had to die for it to become a better situation for you!!
Good luck, although I dont think your going to need it at this point because she has sealed her own fate!
