Mother unable to see her children

I have a really good friend of mine who is going through a really bad divorce right now and needs all the help she can get. It's quite a heart breaking story and I really want to help her out so I decided to come here and see if I could get any answers.

Apparently, she got pregnant by a socialite in Palm Beach who comes from a family with a great deal of money. To make a long story short, she ended up having two children with this so-called "gentleman" and they later got married on a Caribbean island as apparently he didn't want her to have his last name for reasons which are quite apparent.

He eventually kicked her out of his house and made her sign documentation stating that she is an unfit mother outlining a bunch of private things that happened in her past before she met him such as abuse, etc. Apparently, the so called gentleman feels this woman is not fit to be the mother of his two beautiful children. She is a gorgeous girl who went through some terrible stuff in her younger years and he is using that against her and alienating her completely from her children. I can't believe a country as great as the United States would let this happen to a beautiful woman and her children.

She calls and wishes to see her children but he doesn't even pick up the telephone and doesn't even let her talk to her kids. This to me is completely unfair but of course I don't have all the information. Would any judge in the World let this happen?

She is obviously completely crushed by this and I just wanted to see if there is anything I could do to help her out. She has a lawyer working on this but I'm not sure he is doing his job. In the documentation, she is supposed to get a settlement of $100,000 to basically make her "go away". I have been all over the World myself and seen several situations like this and normally the mother will always have custody or at least partial custody of the children.

Is this legal and if so, is there any recourse for her whatsoever? In the future, will she be able to get a court order to make him see her children. I find this whole situation to be quite appalling as this is really hurting the children more than anyone. Please advise and thanks for your time and consideration.

I am just trying to do the honorable thing and help her out like any real friend would. She really doesn't know what to do and I figured this avenue would possibly shed some much needed light on the situation for her. I know everyone is really busy with their own lives but sometimes I think it is important to lend a helping hand whenever possible. I hope something good will come out of this attempt. Thanks again.

She needs a good attorney. She needs to be very candid with that attorney about what she really wants.

Its possible that she doesn't have a decent attorney, but its also possible that she is not being entirely candid with you.

That is definitely the impression I am getting too. I can completely understand her not being entirely candid with me as this is a very difficult and embarrassing situation. However, I'm just trying to help. Thanks for your advice.

Based on what I wrote initially above, does she have a chance in a worst case scenario? Or could she totally have her back up against the wall if she signed a certain type of definitive documentation? Thanks again for your help.

When did the break up happen? How old were the kids? When did she sign this definitive documentation? When was the last time she had contact with the kids? How old were they? How old are the kids now?

What does this definitive documentation say?
Why did she sign it?

She will always have a chance unless she signs a document relinquishing her parental rights.

There is a mentality on that lovely island to the south of me that they are above the law. But, even THEY can't terminate her parental rights in such a manner without a step to adopt. I'm trying to remember which socialite they did that same type of thing to.

Since it appears that it is NOT a done deal, I would advise her to try to get an attorney who would be willing to bill the X. She may have to look outside of Palm Beach county and see if she can get someone from either Broward or M artin who would be willing to take it on.

I am a little concerned that the mom is perhaps ok with being "bought off" and isn't admitting that to the OP.

I agree with LD. Mom may be okay with the idea of walking away with money but she is using this argument to make herself look better.

I'm going for the benefit of the doubt here, but she wouldn't be the first one to put $$ before children if Ld's suspicions are correct. I too had that thought.

Seriously, $100,000 to give up your kids? Wouldn't have happened even if the offer had been a billion.


Tell your friend to get an attorney if her motivation is "really" about seeing the kids.
