If you're going to contemplate suing, you have to have certain specific injuries to bust out of the NJ no-fault rules. NJ auto insurance is an ungodly mess, thanks to the legislature being primarily stocked with personal injury attorneys. I was ever so happy (and my premiums went down 90%) when I moved south.

Given the level of injuries the OP has, he should visit with a personal injury attorney to see if there is any liability that can be outsourced. Not just auto insurance, but product liability, road design or construction liability, or any other recourse.

Yes the accident was my fault. Im still going through physical therapy and would have to wait to file for bankruptcy. What are the requirements for filing for bankruptcy?
I would say the first thing to do is find a bankruptcy attorney. Way too complex a process to deal with on your own.

The requirements for filing for bankruptcy? An inability (for whatever reason) to pay your debts.

You might want to sit down with a bankruptcy attorney in your area to discuss your current financial situation and the medical debts that are building up.

Again, if you will have additional medical expenses, now might not be the best time to consider filing. You do not want to find yourself back in the same situation a couple of years from now with no bankruptcy option available to you.

Although I know the debt is worrying you, you should try to concentrate on getting your body healthy again. That is your primary goal. Financial health comes after that.

And, as TigerD mentioned earlier, it would not hurt to see if some "fault" for the accident (and therefore expenses) can be shared by another or others. If your bike had a defect, for example, that could be a contributing factor in your accident, this should be explored.

Good luck.
