I was involved in an accident on 4/14/05 at approximately 6:00 AM in downtown Houston. I was riding my motorcycle, traveling eastbound on McKinney at the posted speed limit. The other vehicle involved, a Lincoln Town Car, was heading northbound on Travis. The mayor of Houston recently had all of the stoplights downtown retimed so they all cycle at relatively the same time from one block to the next in the direction of travel (i.e. if your light is green, all of the lights are green in your direction of travel). To the best of my knowledge, all of the lights in my direction of travel were green when I entered the intersection of Travis and McKinney, when BOOM!!!!!, I was hit by the Lincoln.
The driver of the Lincoln claims he had a yellow light when he entered the intersection. This guy was a limo driver with two passengers in the back on the way to the airport. The passengers statements basically said they didn't see what color the light was when the accident occurred, and since it was 6AM, there weren't any other witnesses to the accident (I'm sure others saw, but just decided not to get involved and kept on going).
So...the officer didn't assign any faults in the accident and said that it's basically my word against the limo driver's and to take it up with the insurance companies.
What do I do??? Is this guy just going to get off??? We all know, that in most cases like this, both insurance parties deny responsibility and don't pay out to either party. Would the same be true if I would have died in the accident??? "Oh well, there were no witnesses...sorry your husband of 5 children lost his life...but since no one saw what happened there's nothing we can do."
Since I drive a motorcycle, the person that clearly stands to lose in a game of risking lives should an accident occur would be me. Red or yellow lights for me ALWAYS cause me to stop...I never enter an intersection on the yellow b/c of the other idiots on the road. Yet this guy claims he had a yellow light and that's it? All is said and done?
