Move with child during divorce?

I'm seriously considering divorcing my husband and need to know if I can do this. We live in New Mexico, and I'd like to move back home to Boston during the divorce. We have a two year old little girl. Would i be able to do this? Would the way he treats her play any part?

Any advice would be appreciated!

Has divorce proceedings began? Has anyone filed yet?

Nothing has been filed yet. Would that make a difference?

Absolutely. Once something is filed, you cannot take the children out of the area. If nothing has been filed you can go. BUT....after you leave and he files...You will most likely have to return. If you leave and establish residency where you go....then you can file and he would have to come to you. This is an iffy situation and are advised to proceed with caution. Do you really want to take the children away from the Father like that?

It's not that I want to take her away from her father. I left my family and friends when I moved out here to be with him. I have no support system so far away from "home"
When we had discussed divorce a couple years ago he threatened to take her away from me. I don't know, it's a complicated situation. I've discovered he was the same with his ex-wife and two boys. Never acknowledged the kids, very controlling, verbally abusive, yet when in public plays perfect husband and daddy. I just don't want my daughter growing up thinking this is how a husband and father should act like... Sorry if I've babbled. :-)
