I had shoulder surgery last August. I was out of work for three weeks. I had a torn rotator cuff repaired, a bone spur removed and had a lot of impingement which was fixed. The surgeon told me I would have none of the pain I had before surgery after the procedure, and he was right. From what you say you had an open repair, mine was arthroscopic. With an open repair you can be out of work for three months. I live alone, I had no help, which I thinked helped a lot, there was no one to baby me. I had four physical therapy sessions before I went back to work. What kind of work do you do? Are you so disabled you can do nothing? I know every case is different, but this has lasted too long. For me, I wanted to go back to work asap, I did not want to be on disability at 60% of my salary. I think getting back out into the workforce would probably help you.

Why should she go back to work? This is better than Welfare! It's too much fun "living off the system", popping Bon-Bons and watching Oprah.

Great I work hard and my tax dollars get pissed right down the drain. I say if you can afford Bon-Bons and cable then your @ss needs to be working.

Most employers have light duty work. Also if the money is lowered that means that W/C did an independent medical exam and found this person is not as bad as they say. W.C is a big business. Dr's and lawyers love this. I could walk into my dr'd office now and say I hurt myself and work and now im in pain (ouch wow it hurts so much) and get something. It stinks.

Beside I wake up stiff every morning. I could pop some pills but I know once I get up and move around around Im good. My problem is easy though. Its lack of sex and I dont think I could get W/C for that!!!

This does not have to do with workers' comp, but it sure does illustrate what mind over matter can achieve. There is an employee in my office who has rheumatoid arthritis, probably juvenile. She doesn't have to work, but she does. Many of the arthritis meds do not help her. She had hand surgery a few years ago to try to straighten out her fingers, her hand was in finger splints for at least a year, she still worked. She is married and wanted a child. To achieve this she had to go off her medications. This meant being so stiff she could hardly walk, but she still worked. She was off her medication for about nine months and one miscarriage before she became pregnant, she was then still off her meds until after the first trimester, she still worked. She delivered a healthy baby boy in April. She just came back to work. I have a great deal of respect for her and what she has been through. Here is a person who does not have to work. She probably could be on Social Security disability. But she choses to work. She is always, through everything, smiling and in a good mood, I don't know how she does it, but she has learned to accept what life has given her. This is the kind of person who should be held up as an example to malingerers. Pele

I have not replied to your remarks about my last post on June 8th of last year. It is now April 2005. I have been working since last October...I had to have further surgery due to the fact that my original Dr...had left me with nerve damage. NOW...for all you people that said I was lazy...mallingering and working off the welfare system...YOU ALL KNOW WHERE TO GO.
For those who are serious....my case still has not closed and I was wondering now that I have been working, how much longer do you think that it will remain open? I haven't received any monetary award or payments since December of last year.
ANY REAL INPUT WOULD BE APPRECIATED.

A whole year and still harboring hard feelings... bet you have an ulcer now too.
I am sure cbg or beth will answer your questions if you shoot the tude down and ask specifics... do you think they have time to read the whole stupid thread again... jeesh.. they spend their precious time helping... why... I do not know... but why the tude?

I am not sure if there is a specific time frame as to the length of time your case will remain open. I am assuming from your post that a worker's compensation law suit has been filed against the insurance carrier. If a law suit has been filed, you are pretty much at the mercy of the courts as to times and dates. Perhaps your attorney will need to file a motion to set trial. I would think if the treating physician has left you with nerve damage you may want to pursue legal remedies against him as well. Good Luck.

Don't take what these guys are saying too personally. I don't think they mean to attack you; however, your intitial post seemed "shady" at best (sorry but that is the best word that I can use to describe it). So of course, the inititial reaction was to think the worst. Sorry for the aggravation.
