Califronia is my state I am 19 years old and my ex is 5months pregnant and she has made up her mind to do adoption. But I want to keep my son. I am taking her to court for proof of parantage and custody of my son. I have a Job and I am going to school. Is there anyways that the judge won't grant me custody of my child. And is it even legal for her to do adoption without me signing away my parental rights..

Once the child is born you need to immediately file to establish legal paternity, custody and child support.

The child cannot be adopted without your consent. Unfortunately CA does not have a Putative Father Registry but either way, don't sweat it too much at this point.

Mom seems to think this is much easier than it actually is; she's in for a surprise.

There is nothing you can do until the baby is born.
Then you may establish paternity/custody through court.

So even though she put on the adoption packet that I am the father I have to wait for the child to be born. I started the court process this month so I'm hoping that I can keep my son. Even if I have to pay for a patenity test.

If you object to the adoption - and bear in mind there isn't even a child yet - it's highly unlikely to go ahead. Period.


What court process did you actually start this month?

I'm tryin to be patien buther parents are trying to pick the family out and have her start the adoption process and leave me in the dark the baby is due in 4months and I just don't want to lose my son she won't let me or tell me when the ultrasound appointments are. So I really don't know what the best way to go about this is. I'm only doing what I think is right she is almost in the 3rd trimester

Have you filed an OSC already? You need to get yourself into court and let the judge know she's planning on putting the child up for adoption, ask him to restrain her from doing so until the results of a paternity test are known. Do you have any proof of such?

Be aware, she may go 180 on you once in court and decide she's going to keep the baby, which is fine, you'll share legal custody and have visitation, but you'll also be paying support.
