Dude - I suspect CC knows a bit more than you do about the law. You really should consider sitting down, reading and learning, with your fingers still.

There is nothing you can do until the baby is born.
Then you may establish paternity/custody through court.

NOT TRUE. He can file to establish paternity/custody NOW though it will be held in abeyance until the child is born.

You are an idiot. HE can FILE now. You can't spell and have no clue of the law.

I'm going to hold off on calling you what I really want to call you at the risk of being banned. So you tell me how long you've worked in family law in a courthouse in CA? I guarantee you, if I only count last week, I have you beat.

Am I drunk, unfortunately not. Are you stupid? Absolutely.

The mother can leave the state, and if you read the restraining order on the summons, after she's served, she's restrained from removing the child from the jurisdiction of the court. She must come back, for no less but any hearings

She could have a miscarriage - she could have a miscarriage because today is Monday. Papers don't bring on miscarriages

The child is unborn. Yes, it is - and there are places on the petition to indicate that. You think that if the Judicial Council didn't want to include unborn children as an option on a petition, they wouldn't include it? Go ahead, go look for it. I guarantee you it's there.

Please...Just shut the heck up. There are many state that CAN prohibit a pregnant woman from leaving the courts jurisdiction.

If you don't stop with your stupid, uneducated and LEGALLY incorrect postings I will start reporting EVERY ONE. You will be banned.

DAD10 will now attempt to lock this thread.
He'll attempt, but since it's not his....

However, I'm waiting for next year, when he becomes DAD11 and still tormenting his ex. I mean really, I'm beginning to understand his ex with each and every one of his posts.

I actually think it's good that he can file now even though nothing can proceed until the child is born. Now, OP knows where mom is.

I hope OP is prepared for both extreme possibilities - one, that mom will have nothing to do with the child and do everything in her power to avoid paying child support; or two that she will suddenly become extremely posessive of the child and make his shared custody/visitation a nightmare for the next 18 years. I hope neither is the case, I hope they are both able to put the child first and be good co-parents. But he should know what's possible.
